1. Terms and Conditions

The Aloha Browser Referral Program (the “Program”) offered by ALOHA MOBILE LTD (“Aloha”) has been especially created to reward You, our royal User for doing what you already do: that is to recommend the Aloha Browser experience to friends, colleagues and family who choose to use Aloha Browser. Our Referral program has also been created to offer these Referrals great rewards for choosing to use the Aloha Browser.

These Terms and Conditions contain important information about our Referral Program, so please read them carefully. These Terms and Conditions form a binding agreement between You and Us and will govern your participation in our Referral Program. You need to accept these Terms and Conditions in order to participate in our Referral Program.

Please note that we fully reserve the right to modify these Referral Program Terms and Conditions at any time and at our sole discretion, by posting updated Terms and Conditions on our Website and indicating the date of the last update, and without giving any notice to you. Your participation in our Referral Program is considered as an acceptance of these Terms and Conditions and any modifications which might be made. Also, and at our sole discretion we might change, cancel, suspend, or modify any aspect of the Referral Program without notice.

We also reserve the right to disqualify you at any time from participating in our Referral Program in cases where, for example, you abuse the Referral Program. Exampled of such abuse include but are not limited to: (a)any unsolicited commercial e-mail or “spam”; (b) acting in violation of these Referral Program Terms and Conditions; c) damaging, tampering with or corrupting the operation of the Referral Program or our Website; d) acting with intent to annoy, harass, or abuse any other person; e) any inappropriate, uncooperative, disruptive, fraudulent, potentially fraudulent, or unusual behavior or activity; or f) activity deemed in our sole discretion to be generally inconsistent with the intended operation of our Referral Program. We shall be the sole determiner in cases of suspected abuse, fraud, or breach of these Referral Program Terms and Conditions.

2. Eligibility

In order to participate in our referral Program, you must already be a current Aloha Browser User. Both you and the Referred must be at least 18 years of age.

3. How the Program Works

Upon signing up for the Referral Program you will be issued with an anonymous unique identifier. This is needed solely in order to track your referrals and your rewards. This anonymous unique identifier will not be used for any other purposes.

You are only eligible for one Referral Account. Multiple Referral Accounts are forbidden and might lead to your disqualification from our Referral Program.

You will be rewarded with Aloha Browser Premium features (“Achievements”) for free as follows:

• 1 week of Aloha Browser premium features for 1 - 9 referrals;
• 1 month of Aloha Browser premium features for 10 - 99 referrals;
• 1 year of Aloha Browser premium features for 100 - 999 referrals;
• 2 years of Aloha Browser premium features for 1000 - 9 999 referrals;

Lifetime premium features of Aloha Browser for 10 000 referrals;

Achievement milestones might be changed and/or modified at any time and without any prior notice.

Being the great browser experience that we are, we are also full of surprises. Watch out for any surprise hidden Achievements that we might throw your way for you to unlock and enjoy!

In order to be able to track and monitor your Achievements and claim them you need to enable “Push Notifications”.

Your Achievements are non-expirable (timeless), non-changeable, non-refundable and non-transferrable. Furthermore, Achievements cannot be exchange for money.

3. Opting-out

If you wish to opt-out from our Referral Program, please send an opt-out request to support@alohabrowser.com. By opting out all of your Achievements will be forfeited and cannot subsequently be recovered

4. Miscellaneous

By participating in our Referral Program, you hereby release Us, our subsidiaries, affiliates, suppliers, advertising, and promotions agencies and their respective directors, officers, employees, and agents from any and all liability for any loss, harm, damages, cost, or expense, including, without limitation, property damages, personal injury and/or death, arising out of or in any way connected to the Referral Program and/or the use of any Achievement rewards.

Indemnification. You agree to indemnify, defend, and hold Us and our representatives and agents harmless from and against any and all third-party claims, demands, liabilities, costs, or expenses, including attorney’s fees and costs, arising from, or related to any breach by You of any of these Referral Program Terms and Conditions or any violation by You of applicable law.

Computer System: We hereby disclaim any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with the Referral Program, and reserve the right, in our sole discretion, to cancel, modify, or suspend our Referral Program should a virus, bug, computer problem, unauthorized intervention, or other causes beyond our control, corrupt the administration, security, or proper play of the Referral Program.

Force Majeure: We shall not be liable to you for failure to supply any Achievement reward or any part thereof, by reason of any acts of God, any action(s)m regulation(s), order(s), or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s), or request(s) prove(s) to be invalid), equipment failure, threatened terrorist attacks, terrorist acts, air raid, blackout, earthquake, tornado, war, unusually severe weather, explosion, labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, or any other similar or dissimilar cause beyond our control.

These Referral Program Terms and Conditions constitute the entire agreement between You and Us concerning the use of our Referral Program. Any failure on our part to exercise or enforce any right or provision of these Referral Program Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of these Referral Program Terms and Conditions is found by a court of competent jurisdiction to be invalid, both You and We nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Referral Program Terms and Conditions remain in full force and effect. The section titles in these Referral Program Terms and Conditions are for convenience only and have no legal or contractual effect. A person who is not a party to these Referral Program Terms and Conditions shall have no right to enforce or receive the benefit of any of these Referral Program Terms and Conditions. This Agreement is governed by and construed in accordance with the laws of the Republic of Cyprus.
